Compulsory civil liability insurance of owners of facilities the activities of which are related to danger of causing harm to third parties

Compulsory civil liability insurance of owners of facilities the activities of which are related to danger of causing harm to third parties is made in accordance with the Law of the Republic of Kazakhstan “Compulsory civil liability insurance of owners of facilities the activities of which are related to danger of causing harm to third parties».

Object of compulsory civil liability insurance of owners of facilities the activities of which are related to danger of causing harm to third parties is the property interest of the facility owner, which activity is connected with the danger of causing harm to the third parties, related to its duty prescribed by the civil laws of the Republic of Kazakhstan to indemnify harm caused to life, health and (or) property of the third parties as a result of accident at the facility.
It is prohibited to run the hazardous facility without the compulsory civil liability insurance of owners of facilities the activities of which are related to danger of causing harm to third parties contract.

Insurance contract is valid during 12 months.

Insured events

Insured event under the compulsory civil liability insurance of owners of facilities the activities of which are related to danger of causing harm to third parties contract is occurrence of civil liability by the insured for indemnification of harm caused to life, health and (or) property of the third party by hazardous production factor.

Insurance Premium

Insurance premium is established as agreed by the parties within the range of 0.72 – 2.02% of the insurance coverage
Insurance coverage is fixed as follows:

Insurance coverage value If maximum number of victims as the result of the detrimental effect of hazardous production factor is:
600,000 MCIs over 4,000 people
350,000 MCIs from 2,000 to 4,000 people
225,000 MCIs from 1,500 to 2,000 people
115,000 MCIs from 750 to 1,500 people
50,000 MCIs from 300 to 750 people
30,000 MCIs from 150 to 300 people
12,000 MCIs from 75 to 150 people
5,000 MCIs from 10 to 75 people
1,000 MCIs Up to 10 people

Insurance coverage for harm caused to life and health of each third party is fixed as follows:

1) death — 1,000 MCIs;

2) if disability case is registered:
I category — 800 MCIs;
II category — 600 MCIs;
III category — 500 MCIs;
disabled child — 500 MCIs;

3) dismemberment, trauma or other harm caused to health without disability case registration – in the value of actual expenses incurred due to outpatient and (or) hospital treatment in any case not exceeding 300 MCIs. Herewith, the value of insurance coverage per each day of hospital treatment shall be at least 2 MCIs.

Harm to property is determined in accordance with calculation of the value of restoration thereof subject to the property depreciation before occurrence of the insured event.

Insurance indemnity is paid by the Insurer no later than 30 business days after the receipt of all documents required to make payment.
